Action 9: Car Owner Surprised By Warranty Terms

Hal Downing said he stopped driving the 2003 turbo Volvo he bought in December because it developed transmission problems two months later.

Downing said the transmission needed to be replaced, but when he tried to file a claim using the protection plan he bought from Auto House in Salisbury, it was rejected.

The warranty company said it didn’t cover turbo transmissions like Downing’s, even though that’s not written in the contract.

“There's nothing in the protection plan that says anything about turbo or anything else,” Downing said.

The finance company did remove the $2,300 Downing paid for the warranty from the financing, but he said he still couldn’t afford the $7,000 to repair the transmission.

Downing blamed Auto House for selling him a warranty that he said didn't protect him. He also said the manager and owner wouldn’t talk to him.

“They simply say, ‘It’s not our problem,’” Downing said.

Action 9 talked to the owner, Nathan Brown. He said he wasn't aware the warranties he'd been selling excluded certain transmissions from coverage.

After Action 9 got involved, Brown said he will now stand good for the warranty.

“If we sell a contract and we assume that it’s covered and it’s not, it’s going to fall back on us,” he said.

Brown is now paying to have Downing's car fixed.

Now, Downing has a warning about extended car warranties.

"If they say warranty, make sure you know what they're talking about,” he said.
